General Terms And Conditions Of Use
GENERAL TERMS AND CONDITIONS OF USE OF THE ACCOUNT SERVICE FOR ACCESS TO THE PERSONAL AREA OF THE WEBSITE
This document sets out the general terms and conditions (“Account Terms and Conditions”) of the service designed to offer customers who use the website www.eurotrol.it (“Users”) the opportunity to create an account to easily access their personal account area.
Acceptance of the Account Terms and Conditions and acknowledgement of the Privacy Policy drawn up in accordance with data protection legislation are necessary conditions for the creation of the Account.
Please read these Terms and Conditions carefully and print a copy and/or save them on a durable medium.
ART. 1 – SCOPE OF THE SERVICE
1.1 The Account service was developed by Eurotrol S.p.A. a Socio Unico with the aim of making the registration process easier for its users and enabling them to log in independently using their own credentials (user ID and password) to their personal area on the website www.eurotrol.it.
1.2 Any data provided by Users will be used solely for the purpose of creating their Account profile, and will be processed in accordance with the terms set out in the Privacy Policy.
1.3 Creating an Account will not result in the automatic activation of any service or the purchase of any of the Company’s products.
ART. 2 – CREATING AN ACCOUNT
2.1 You may register for an Account using unique login details (email address and password) that are not linked to a social media account and which will be generated/registered once the relevant procedure has been completed.
2.2 If the Account creation process is started but not subsequently completed, the Account creation process will lapse without any registration taking place.
2.3 Once the registration process has been completed, an email confirming successful registration will be sent to the customer using the email address provided during registration.
2.4 Creating an Account will not automatically result in data being shared.
ART. 3 – USER’S RESPONSIBILITIES
3.1 The User undertakes to provide a valid email address when creating their Account. The email address will be essential for the correct identification of and communication with the User.
3.2 By accepting these Terms and Conditions, the User confirms that the personal data and information provided during the account creation process are up to date, accurate and truthful. Eurotrol S.p.A. a Socio Unico reserves the right to verify the validity of the email address provided by the User. If the email address provided is invalid, the User will not be able to complete the Account creation process.
3.3 The User agrees to receive official communications relating to the Service exclusively via the email address provided when creating the Account.
3.4 The User undertakes to use the Account exclusively for lawful purposes and in accordance with the applicable legal provisions in force, established practice and customary conduct, and the rules of due care, and in any event without infringing the rights of any third party. The User therefore assumes sole responsibility for all their activities in connection with the use of the Service and undertakes to indemnify Eurotrol S.p.A. a Socio Unico against any claim or demand relating to or arising from the use or misuse of the services.
3.5 The User acknowledges, amongst other things, the following:
- Eurotrol S.p.A. a Socio Unico may suspend or terminate the Account’s functionality for valid reasons (e.g. malfunction of the Account, IT security issues, changes in organisational or business requirements, etc.);
- the Service is provided to the User free of charge;
- the User may access the Service for non-commercial purposes, without seeking to make a profit or gain any financial benefit;
- the Service may not be supported by certain operating systems or versions thereof, and it shall be the User’s responsibility to identify the correct combination of software and hardware that enables the Service to be used properly.
3.6 The User must not share and/or forward any content made available by the Service to third parties.
3.7 The User is obliged to comply with and observe the provisions of these Terms and Conditions, which govern the Account service only.
ART. 4 – CHANGES TO THE ACCOUNT TERMS AND CONDITIONS
4.1 Eurotrol S.p.A. a Socio Unico may continue to develop and improve the functionality of the Account, as well as that of the website, and, therefore, reserves the right to amend these Terms and Conditions, as well as to modify, supplement or improve one or more of the components, functionalities or features of the Service for justified reasons (such as the optimisation and development of the Service, extraordinary developments, the need to adapt to statutory or regulatory changes, the need to address security issues, or unforeseen technical or economic requirements).
4.2 The amendments will be made available by publication on the website and by direct notification to the User via email, sent to the email address used to create the Account.
4.3 The amendments shall take effect from their date of validity, as notified by Eurotrol S.p.A. a Socio Unico to Users, unless statutory provisions or administrative measures require an earlier date of application.
4.4 If a proposed amendment does not constitute a material amendment, the User’s consent shall be deemed to have been given unless the User has expressly rejected the amendment in writing (e.g. by email) by sending it to the Company before the date on which the amendment comes into force. Any amendment to these Terms and Conditions resulting from a change in the law, a court ruling or an injunction does not constitute a material amendment.
ART. 5 – LIMITATION OF LIABILITY
5.1 Given, amongst other things, that no consideration is to be paid to use the Service, Eurotrol S.p.A. a Socio Unico shall not be held liable to the User – save in cases of wilful misconduct or gross negligence – for any service disruptions or malfunctions arising from the use of the Account.
5.2 Eurotrol S.p.A. a Socio Unico accepts no liability for any damage, claims or losses, whether direct or indirect, suffered by the User as a result of the failure and/or malfunction of the User’s own electronic equipment or that of third parties, including Internet service providers, or of telephone and/or data connections not directly managed by the Company.
5.3 Eurotrol S.p.A. a Socio Unico shall not be deemed to be in breach of its obligations nor liable for damages:
- resulting from the inability to access the Service due to the malfunction or failure of the electronic means of communication for reasons beyond their reasonable control, including, by way of example, fires, natural disasters, power cuts, the unavailability of telephone lines or other network service providers, the malfunctioning of electronic devices (even those not forming an integral part of the Internet), or the malfunctioning of software installed by the User;
- arising from the actions of other Users or other persons with access to the Internet.
ART. 6 – INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS RELATING TO THE ACCOUNT
The User expressly acknowledges that all industrial and intellectual property rights, including, by way of example only and without limitation, copyright, certifications, know-how, source code, software, hardware, designs, applications, patents, trade marks, trade secrets, formulas, algorithms, models, databases and the like, relating to the Account, the data and other materials originating from Eurotrol S.p.A. a Socio Unico or otherwise made available to the User by the Company pursuant to these Terms and Conditions, remain the exclusive property of the Company and/or their respective owners, and that no rights, other than the right to exclusively personal use in accordance with these Terms and Conditions, are granted to the User in relation to the foregoing.
ART. 7 – ACCOUNT DEACTIVATION
Users who wish to delete their Account may stop using it at any time and deactivate the Service by sending a request to the following email address: comunicazione@eurotrol.it.
ART. 8 – GOVERNING LAW
8.1 These Terms and Conditions are governed by Italian law.
8.2 Jurisdiction lies exclusively with the Court of Milan, Italy.
ART. 9 – COMMUNICATIONS AND SUPPORT
9.1 Any enquiries or complaints regarding the operation of the Service must be submitted to Eurotrol S.p.A. a Socio Unico using the contact details set out in Article 7 above.
9.2 It is reiterated that, when creating the Account, the User is required to provide a valid email address and to keep it up to date at all times; it will be used to send service notifications and any other communications relating to the Account. In the event that any communication fails to be delivered to the email address provided, Eurotrol S.p.A. a Socio Unico shall under no circumstances be held liable.
